Supreme Court of Virginia Rules for Generative AI Use

The rules set the only authorised generative AI use for judicial system work and court-issued devices: compliance training and a certification before use, vetted tools or stated conditions for others, one named application banned outright, and no unattended AI decisions.

Virginia’s rules are the most procedural on this list. Before using any generative AI tool, a user must complete the compliance training video and certify that they have read and will comply with the rules. An appendix lists the vetted tools, and other tools may be used only under the conditions the rules state.

Three limits are worth naming. Users are responsible for understanding the limitations of AI output and for verifying its accuracy and completeness, and may not rely on it as a sole source. One named application is prohibited on court-issued devices outright. And use of an AI system in which the system makes a decision without the involvement of a human decision-maker is not authorised anywhere in Virginia’s judicial system.
